1. Who am I?

Hermsey is the trade name of Imo Hermkens. I am responsible for processing your personal data as described in this policy.

2. Which data do I process?

Through the contact form: your name, email address, company name, phone number, your choice of website, app and/or automation, and the message you send me.

Through the chat, when available: the messages you type in the chat and a random session code, so a conversation stays together. Please don't share sensitive information in the chat.

When you visit the website: the hosting provider's server records technical data such as your IP address, browser type and the time of your visit. This is necessary to keep the website secure and available.

If you become a client, I also process the data needed to carry out the assignment and for invoicing.

3. Why do I process this data?

• To answer your enquiry or question and send you a proposal or quote. Legal basis: taking steps at your request before entering into a contract.
• To answer questions in the chat. Legal basis: my legitimate interest in helping visitors quickly.
• To carry out the assignment and invoice you if you become a client. Legal basis: performance of the contract and legal obligations.
• To keep the website secure and working. Legal basis: my legitimate interest.

I don't use your data for any other purpose and I never sell it to third parties.

4. How long do I keep your data?

• Enquiries via the contact form: up to 12 months after the last contact, unless you become a client.
• Chat conversations: up to 3 months.
• Client and invoice data: 7 years, due to the statutory tax retention period.
• Technical server data: as briefly as necessary, according to the hosting provider's settings.

5. Who do I share your data with?

I only share your data with parties that help me deliver my services (processors), and only to the extent necessary. Agreements are in place with these parties about the security and confidentiality of your data. These are the following categories:

• Website hosting: a hosting provider that keeps the website online.
• Email: Google Workspace (Google), which I use to receive and answer your enquiry.
• Automation: an automation platform that processes and forwards form and chat messages.
• AI assistant in the chat (when available): an AI service that helps answer your questions.

Some of these parties, such as Google, may also process data outside the European Economic Area. This only happens with appropriate safeguards, such as the EU-US Data Privacy Framework or the European Commission's standard contractual clauses. Want to know exactly which party is involved? I only provide your data to other parties if I am legally required to do so.

6. Cookies and tracking

My website doesn't use tracking or advertising cookies, nor analytics services that follow you. Fonts are loaded from the site's own server, not through an external service.

For the chat, a random session code is stored in your browser's storage (sessionStorage). It is deleted automatically when you close the tab and contains no other personal data.

7. How do I protect your data?

I take appropriate technical and organisational measures to protect your data against loss and unlawful use. The website works over a secure connection (https) and only I have access to the enquiries and conversations I receive.

8. Your rights

You have the right to access, correct or delete your personal data. You can also object to the processing, have the processing restricted and request your data in order to transfer it to another party.

Send your request to info@hermsey.nl. I'll respond within one month. To prevent misuse, I may ask you to identify yourself.

Don't agree with how I handle your data? Please let me know first, and we'll look for a solution together. You always have the right to file a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

9. Changes

I may update this privacy policy, for example when my services change. The most recent version is always available on this page.
